Chapter 10  S. O. T. P.

S. O. T. P. stands for sex offender treatment program.  Most people are required to attend one by court order, either through a plea agreement or terms of release.  You are required to pay for this abuse from your own money, which is a nice way of insuring that you get a job.  Fall behind in your payments and you will be violated and sent back to prison.  The term violated his starting to take on a new meaning at this point.  Isn’t it?

If you are unfortunate enough to be required to attend an S. O. T. P. program do a good background check of the instructors credentials.  In one case regarding an S.O.T.P. instructor out of Tucson, a check of the instructors educational and training credentials revealed his background had been falsified.  If you find something like this, turn them in to the court and the press and stop attending.

S. O. T. P is currently being attacked in the courts.  The instructor is required by law to report everything he or she hears to the courts.  Which then makes the participant in the program a witness against himself which is a violation of your fifth Amendment rights.  (See S. O. T. P. case law).

In prison inmates may be required to take an S. O. T. P. class.  However in most cases it will not apply to any S.O.T.P. requirements outside of prison so why take it?  Originally these programs were taught by trained professionals, then they were attacked because the instructors were informing the courts about their students and reporting their findings back to the courts.  Now these programs are run by inmates who follow guidelines for the program on their own.  If you're placed in one of these programs be very careful what you say.  Tell them only what they want to hear if they are operated by a professional.  If your right to appeal remains in effect, you have no business participating in one of these programs and should refuse to attend.

The use of lie detectors is widely accepted and used sometimes as evidence against you even though polygraph evidence is inadmissible in a court of law.  It may be inadmissible in trial, but a different set of rules exists at hearings for probation and it will be allowed.

The use of a plythizmograph (erection detector) is waning although you can still run into their use once awhile.  The use of this machine and the results it produces has been heavily attacked in the courts as being invalid.  Check case law if you wind up with your member in a wringer.  Makes me wonder why there isn't a moisture detector for female sex offenders.  The male bias is profoundly evident here.

The following is a list of items you will be required to provide the therapist in a sex offender treatment program after you have served your sentence.  You will instantly recognize how intrusive this program is by the information you are required to provide them.  Please note that failure to tell them what they want to hear becomes an issue of noncompliance they can bring before the court to send you back to prison.  The statement that this information can not be used against you in a court of law is a lie!  A.R.S. 13-4066(a) specifically states that imformation permissible under A.R.E. 404(b and c) can be used against you in a court of law and we all know that unless the door to such evidence is completely prohibited this exception will be abused by the state.  The interesting thing to note here is that rule 404 is what governs the admissibility of all evidence in Arizona courts.  A.R.S. 13-4066(a) was created to provide the illusion that you are protected when in fact you are not.  In addition there is nothing to protect you from information you reveal in S.O.T.P. being used to bring out of state charges, or federal charges against you at a later time.  The following was obtained from an actual S.O.T.P. program.

Information You Should Know About Your
Upcoming Sexual History Polygraph Examination

Although denial and secrecy obviously served you at one point, no form of secrecy is tolerated in treatment. Despite how it may feel, disclosure results in treatment progress, acceptance by the group and therapist, reduced pressure from probation/parole staff, and personal relief to have purged yourself of the secrets.

By the time you take the sexual history polygraph examination, you already have been given every reasonable opportunity to disclose all the relevant matters in treatment. The examination may take 2-3 hours or more. During the pretest interview, you will have another opportunity to disclosure any information that has not been disclosed in treatment. You and the examiner will create examination questions together and discuss the ability to pass these questions truthfully before you are tested. Your honesty and diligence are mandatory for your success. The examination questions will be repeated several times during the test If your results show deception, the examiner may confront you with the problem and you will be given the opportunity to further disclose any information which may relate to your failure on any given question. Your probation officer and therapist are subsequently advised of the test results via the telephone and/or in writing. The written report will include the relevant test questions, all information disclosed during the examination and the polygraph examiner's conclusions regarding your truthfulness or deception.

Test results showing deception will be presented to the group by the therapist and you will be confronted in group. Probation staff will also address the issues with you, and confer with the therapist and examiner about the results. If you disclose further information, a follow-up polygraph examination may be conducted to determine if you are now telling the truth to the issues in question. If you show deception on an examination, you will be asked to retake that exam at the discretion of probation and treatment personnel. Decisions to expel you from treatment due to polygraph results are made by the therapist in consultation with probation staff. Failure to successfully complete a polygraph examination is not an option. However, providing information that you believe could potentially carry ramifications is often necessary to successfully complete a polygraph examination. These admissions are not to be used in a court of law against you in any way, but are utilized for ongoing meaningful and effective treatment. However, failure to successfully complete a polygraph examination will be deemed non-compliance at the discretion of treatment and probation staff and could result in severe consequences including incarceration.

Probation is a privilege and not a right, therefore, the trial court's discretion is broad in establishing the conditions of probation. The courts do not view the polygraph as a violation of personal rights, but as an agreement by you in accepting probation in lieu of a penitentiary sentence. Because you have accepted this condition as part of your probation, a refusal to be polygraphed or "taking the fifth" is seen as non-compliance and consideration is given to returning the offender to the sentencing court.

After you have completed the sexual history disclosure packet and all victim forms, you will be required to pass the sexual history polygraph, indicating you have fully disclosed all sexual information and have not purposely withheld anything. Complete honesty is crucial to successfully complete your treatment The polygraph examination will be taken at the discretion of probation and treatment staff. Your therapist will provide you with the sexual history disclosure packet. It is required that you bring the completed sexual history disclosure packet with you at the time of your polygraph examination.

If you are currently experiencing serious health issues and/or under the direct care of a physician, please inform your polygraph examiner at the time you schedule your appointment. Also, if you are taking prescription medications please bring a list of those medications to your scheduled appointment.

It is your responsibility to pay for your examination unless you quality for funding. It is suggested that you set aside money from the beginning of your treatment if necessary to pay for your polygraph examination. Please contact your probation officer for any questions regarding your eligibility for funding. If you have any questions regarding your polygraph examination, you are allowed to contact the assigned polygraph examiner regarding those questions.

Remember: "The truth may not lead you to where you thought you were going, but, it will always lead you somewhere better."

FULL DISCLOSURE SEXUAL HISTORYPacket – Instructions

  1. Complete pages 4 through 19 first. DO NOT attempt to complete page 3 (Table of Contents/Summary Information),until after completing pages 4 though 19.
  1. Complete one Sexual Contact/Victim Form (Attachment) for each identified person in pages 4 through 19.
  1. Complete the Table of Contents/Summary (page 3) for Part 1 after you have completed pages 4 through 19.
  1. Complete Part 2 (page 20) regarding other sexual behaviors.

  1. If you need further assistance or have questions, contact your therapist, supervising officer, or other treatment group members as instructed.

  2. Review your written disclosure with your treatment group and supervision and treatment team members, pursuant to the guidelines provided by your community supervision team and treatment group, prior to your polygraph examination date.

  1. Provide your treatment provider and supervising officer with copies of your completed sexual history disclosure packet as requested.

  2. Keep a copy of your sexual history disclosure packet for your own records.

  3. Bring a copy of your completed sexual history disclosure packet to your polygraph examination - If you cannot do so for whatever reason you are responsible for making alternative arrangements. If you are currently incarcerated, your supervising officer or therapist will provide necessary arrangements.

  4. Direct all technical questions about the polygraph test to the polygraph examiner. Soliciting information about the polygraph from friends, books or other media is unlikely to improve your test results and tends to be correlated with cynicism, resistance, unresolved test results and failure to progress in treatment.

  5. Any attempt to falsify or alter your polygraph examination results will be regarded as non-compliance and a deliberate attempt to interfere with the process intended to assure and promote safety in the community and your progress in treatment. Such behavior will become the basis for sanctions in treatment and supervision.

Here is another aspect of the S.O.T. P. you will have to participate in.  To be honest I can’t see how this is supposed to help you.  The following was obtained from an actual S.O.T.P. program.

SAMPLE ASSAULT SCRIPT - First molest of 10 y.o. niece at age 18.
Phase One involves sitting still in one place and thinking about one's current life, what is dissatisfying, what I need emotionally and/or sexually to feel better and then thinking about where and how I can get it. When one thinks of who and how to meet the need, the mood shifts 180 degrees from frustrated, hopeless or just bored to excited and hopeful. That motivates fantasies, planning and finally optimism that one can actually execute a plan that will meet those frustrated needs. Adrenalin starts kicking in.

One of the carrots that is dangled before you is the policy that you can request the court to terminate S.O.T.P. if you pass a specific offense polygraph. If you truly believe in your heart that you can pass this type of polygraphic examination then go for it. But before you make that fateful final decision please read what is contained below to learn just exactly what it is they're going to ask you for a specific offense polygraph. You should know in advance what you are getting yourself into.
